Our litigation group is nationally recognized for its representation of major corporations and other institutions, as well as their executives, in complicated director and officer liability litigation. We offer our clients the full scope of expertise and many years of experience in this area.

Overview

We regularly represent our clients in complex matters involving alleged breach of director and officer duties and issues of liability insurance coverage for such exposures. We aggressively litigate disputes relating to “claims made” policies, issues of “insured vs. insured” exclusions, complex coverage issues and fidelity bonds in order to maximize our clients’ protection under such policies.

Notable Experience

  • We successfully defended the former president of one of Louisiana's largest health maintenance organizations against multiple civil actions brought by the company's Receiver. We settled the case on terms highly favorable to the client using insurance company proceeds rather than the client’s personal funds.
  • We successfully defended a senior bank officer against professional liability claims filed by the Louisiana Insurance Commissioner, again protecting the officer and bank by shifting the risk to liability insurers (2021).

Other experience includes:

  • Secured a reversal and remand of an award of $72 million in sanctions against a federal banking agency in a director and officer liability case arising out one of the largest bank failures in U.S. history. The firm was hired to handle the matter on appeal from the sanctions award. FDIC v. Maxxam, Inc., et. al., 523 F.3d 566 (5th Cir. 2008).
  • Successfully defended a major Louisiana financial institution against claims by a discharged senior officer (2018).
  • Successfully defended the former President of a Louisiana energy services company against professional liability claims brought by a corporate creditor, settling the case on highly favorable terms that fully protected the client from any exposure (2021).
  • Successfully defended an international public relations firm against high-profile professional liability claims by a national utility company (2019).
