CCS is expected to see significant activity during the 2026 Louisiana Regular Legislative Session. If you are currently engaged in the CCS space, or considering becoming involved, visit this page for ongoing updates from CCS attorney and lobbyist Neil Abramson and CCS attorney Jeff Lieberman.
Initial Session Update 1
Speaker Pro Tempore Mike Johnson filed three CCS bills on January 12, which was the first day to prefile legislation for the Louisiana legislature’s 2026 Regular Session. Read the full list on Liskow’s Perspectives here.
Initial Session Update 2
More than 40 bills tied to Carbon Capture and Sequestration (“CCS”) have been introduced during the 2026 Legislative Session—nearly double the volume seen in 2025—highlighting increased focus on the industry in Louisiana.
The proposals generally fall into three key areas:
- Authorizes Local Control Over CCS Operations
Several bills would give local parishes “veto” authority over CCS projects. - Removes/Restricts Expropriation Ability of CCS Companies
Proposals would limit or eliminate the ability to expropriate land for CO₂ pipelines, including restrictions tied to foreign entities. - Expands Liability for CCS Operations
Some bills would remove statutory caps, increasing potential liability for CCS-related incidents.
As of now, HB 7 is the only bill to have received a hearing and did not advance following a 7–12 vote. HB 79 is being heard today in the House Civil Law Committee, and HB 841 is scheduled for Wednesday in the House Natural Resources Committee, while all remaining bills await consideration.
