Overview

The firm routinely and successfully litigates and defends antitrust claims of conspiracy, monopolization, tying, concerted refusal to deal, price fixing, price discrimination and other restraint of trade allegations. Liskow lawyers defend business entities in criminal antitrust investigations brought by federal and state authorities, and defend claims made under Louisiana’s Unfair Trade Practices Act. The firm also offers comprehensive preventative advice in all areas of antitrust law.

Notable Experience

  • Obtained dismissal of Sherman Act claims against a division of Baker Hughes for lack of antitrust standing.
  • Successfully defended one of the nation’s largest consulting firms against antitrust price fixing claims brought by the Louisiana Attorney General in the wake of Hurricane Katrina. Following a U.S. Fifth Circuit ruling upholding removal of the case under the Class Action Fairness Act, we secured dismissal of all claims against the firm’s client.
  • Obtained a dismissal for Tenet Corporation and Meadowcrest Hospital of alleged attempted monopolization and general restraint of trade claims brought by a parish government in the aftermath of Hurricane Katrina.
  • Secured dismissal of antitrust claims filed by the Louisiana attorney general against one of the nation’s leading pharmaceutical manufacturers.
  • Defending one of the nation’s largest pharmaceutical companies against claims of deceptive/unfair trade practices, racketeering and related claims in multiple opioid cases.
  • Working with leading attorneys around the nation, participated in securing reversal of a $416 million antitrust judgment against Blue Cross Blue Shield of Louisiana which threatened the future of Blue Card insurance in Louisiana (2021).
  • Working with leading attorneys around the nation, successfully defended one of the world’s largest financial institutions against claims of price fixing in the national bond market brought by the State of Louisiana (2021).
