Overview

Wind, solar, and carbon capture, utilization and storage (CCUS) are the energy sources and low carbon technologies of the future. In counseling clients through these complex projects, we have the firsthand knowledge and experience to see both the big picture and the immediate, microscopic one. We can, and do, assist clients in every project phase, from planning to acquisition, financing, insurance, permitting, and operation, all the way to decommissioning. Further, as renewable projects are multifaceted and typically draw on multiple practice areas, we assemble coordinated, highly integrated multidisciplinary teams. Whether a project needs capabilities in tax law, insurance, financing, environmental, land use and zoning, corporate, or other fields, our firm is truly a source for all of it.

On target for onshore projects

For onshore renewable and CCUS projects, we have handled, among other things, land rights acquisitions, title insurance underwriting, financing, taxation, asset acquisition and divestiture, construction, regulatory, and environmental issues. Our attorneys are particularly capable of working with clients in a project’s early stages to help anticipate and plan for issues that arise later in a project’s trajectory. These are often connected with land use issues. We’re highly experienced in the nuanced, complex, and interrelated legal and regulatory issues of negotiating and drafting leases, options, servitudes and other interests, title questions, and the interplay between state and local law and project operation.

Unmatched offshore experience

For offshore projects, which are an increasing component of the renewable energy industry, our historic expertise in offshore oil and gas projects provides a knowledge base clients find invaluable. Our offshore renewables team, developed specifically for these projects, assists clients with issues that can arise during permitting, development, construction, and operation of these projects. These include construction finance, tax credits, engineering, procurement, construction and installation contracting, transportation, regulatory issues, and, if necessary, representation in disputes and administrative appeals.

Regulatory experience means client results

In as heavily regulated an industry as offshore energy, experience counts. We have the relationships, track record, and credibility that make us effective, strategic, and knowledgeable guides through what can be a labyrinth of agencies and regulatory structure. We are experienced and work day-to-day with the Bureau of Ocean Energy Management (BOEM) and the Bureau of Safety and Environmental Enforcement (BSEE) on Outer Continental Shelf Lands Act (OCSLA) leasing and operational permitting issues, as well as compliance with the Coastal Zone Management Act, Endangered Species Act, Clean Water Act, Clean Air Act, and various Coast Guard and U.S. Army Corps of Engineers requirements.
