McGoey and James Win Employment Discrimination Arbitration

Liskow & Lewis lawyers Tommy McGoey and Kindall James, members of the firm’s labor and employment law practice group, recently won an arbitration for a Louisiana hospital in a Title VII race discrimination, hostile work environment harassment, and retaliation case. The plaintiff, a former employee, alleged that she was subjected to racial harassment by a group of co-workers and her supervisor for more than a year and that she got no relief from hospital management despite numerous complaints. She also alleged that the hospital’s termination of her employment was racially motivated and retaliation for her complaints of harassment. Over a four-day hearing, McGoey and James demonstrated that that the plaintiff, a phlebotomist, was terminated for violating laboratory and patient’s rights policies. They also persuaded the Dallas-based arbitrator that the harassment was not "based on race" so as to violate Title VII. The plaintiff’s claims were dismissed with prejudice, and the hospital was fully vindicated.
