James A. Brown and
K. Todd Wallace of Liskow & Lewis have secured dismissal of antitrust price fixing claims filed by the Louisiana Attorney General against McKinsey & Company, Inc., one of the world's largest international consulting firms, and several co-defendant insurance companies. In a December 17, 2008 ruling, the U.S. District Court for the Eastern District of Louisiana exonerated McKinsey and its co-defendants, ruling that the Attorney General's claims that they had engaged in a conspiracy to fix prices on property damage payouts to insureds following Hurricanes Katrina and Rita were not plausible and therefore should be dismissed as a matter of law. Mr. Brown and Mr. Wallace, along with other attorneys, had previously developed a theory for removal of the case from state court to federal court on the grounds that the case was a "disguised class and/or mass action" subject to removal under the Class Action Fairness Act of 2005.
